Scope and Content Note
This series consists of transcripts of rebuttal testimony and accompanying exhibits submitted by the attorneys representing the Long Island Lighting Company (LILCO) to John J. Kelliher, Secretary of the New York State Public Service Commission. The rebuttal was compiled in order to rectify what it felt was the PSC's distorted and biased view of LILCO's decisions and actions concerning the Shoreham Nuclear Power Plant.
The basic tenet of the rebuttal testimony is that the commission's condemnation of LILCO was grossly deficient and unfair. The testimony finds fault with the commission's findings on several levels. The charges include: failure to conduct a fair and unbiased investigation; failure to develop a proper standard by which LILCO could be judged; failure to compare LILCO's actions and decisions with those of other managers; failure to avoid the use of hindsight; misuse of documents by selectively quoting out of context or misquoting; exclusions of any information demonstrating reasonable behavior on the part of LILCO which suggests a predetermination of guilt; failure to verify the factual basis of the charges; and a failure to properly qualify excess costs of any alleged unreasonable acts.
The rebuttal testimonies and exhibits submitted by LILCO are part of the overall documentation pertaining to the "Proceeding to Investigate the Cost of the Shoreham Nuclear Generating Facility." This proceeding was initiated by the PSC in May, 1979 to investigate the cost of the Shoreham Nuclear Power Station and to determine whether those costs were prudently incurred.
In addition to the rebuttal testimonies and exhibits, the series also contains a letter of transmittal and a list of witnesses and their qualifications. The letter of transmittal contains a lengthy discussion on the history of the proceeding as well as a summary of the rebuttal testimonies.
