Administrative History
A marketing order is issued by the commissioner of the Department of Agriculture and Markets pursuant to Article 25 of the Agricultural and Marketing Law which prescribes rules and regulations governing the marketing, distribution, handling and sale of any agricultural commodity sold in New York State. After a hearing has been held to discuss the pros and cons of a proposed marketing order, a referendum is taken and the order will be deemed to have been passed or defeated according to certain qualifications outlined in Article 25.
A marketing order may be amended or terminated if a petition to that effect has been signed by 25% of the producers, a public hearing has been held and the prescribed number of votes recorded.
